Constitution of Samerica
Article 1- A citizen of Samerica is anyone who; was living in Samerica at the time of it's founding, or was a citizen of TWD, or was born on Samerican soil or to at least one Samerican citizen, or is serving or has served honorably in the Samerican armed forces, or takes on oath of citizenship and relinquishes all foreign allegiances before an immigration official or military officer of the Samerican government.
Article 2- Samerica will be governed by a national government, each respective settlement in Samerica may be governed by it's own local government, if 51% or greater of that city's population votes to establish a local government. No local government may create a local law that conflicts with a national law. When doubt arises, a national law will always take precedence.
Article 3- The local and national governments of Samerica will be a direct democracy as follows: the president or mayor is the head of the government. It is their responsibility to enforce laws created by the government using the government agencies assigned to them. Laws can be created and repealed only by conveying a national or local convention, in which all citizenry of the respective government is invited to attend, propose laws, and vote on actions. The head of government will convey a national convention at regular intervals, and will ensure that all actions passed were voted on by at least 51% of the attendees. In situations where the total amount of attendees does not equal at least 90% of the population, the head of government will make a judgement call as to whether or not is it fair to pass the action and will dismiss or convey the convention accordingly.
Article 4- The head of government will serve a term of 1 year, and will be up for election upon expiration of their term. To be elected or re-elected head of government, you must be a citizen of Samerica, and must recieve a nomination of candidacy from a national (for president) or local (for mayor) convention.
Article 5- The national government reserves the right to regulate the minting of currency.
Article 6- Local governments may execute full authority over their jurisdictions, withholding the following exceptions. Local governments can not: mint currency, declare war, enter into agreements will foreign governments, or restrict any rights given to private citizens by the national government.
Article 7- Private citizens are entitled to the following rights; the right to engage in commerce without government regulation, the right to engage in commerce only at their own will, the right to bear arms, the right to travel freely within the borders of Samerica, the right communicate freely, the right to practice religion freely, and the right to seek and recieve medical care.
Article 8- War may be declared by the national government only when a declaration of war has been approved by a national convention with a 51% or greater vote. The president is the commander-in-chief of the armed forces and may deploy the armed forces to combat threats to national security for up to 90 days without a declaration of war. A national convention may order the president to recall any military forces and repeal any declaration of war with a 51% or greater vote.
Article 9- The president will conduct all diplomatic relations, however a national convention may veto any action the president takes with a 51% or greater vote.
